Terms of Service

1. Eligibility and account roles

Peak Athlete is offered to schools located in India and to individuals operating on those schools' behalf. Account access is provisioned by Athlosys (for school administrators) or by school administrators (for PE teachers, students, parents). Scouts are provisioned by Athlosys after verification of their professional credentials.

You agree that you will:

• provide accurate and complete information when creating or updating an account;
• keep your sign-in credentials confidential and notify us immediately of any suspected unauthorised access;
• use the platform only for the role for which your account was provisioned; and
• comply with the role-specific responsibilities set out in your agreement with Athlosys (for schools) or with your school (for staff, students, parents).

2. School responsibilities

Each participating school is responsible for:

• obtaining and recording the parental consent required to upload a student's personal data, biometric measurements, and medical observations to the platform;
• configuring scout-discovery, medical-clearance, and other consent-gated features in line with the school's own policies and applicable law;
• managing the lifecycle of PE-teacher and student/parent accounts (invitations, role changes, deactivation when staff or students leave); and
• ensuring the accuracy of school-supplied data, including roster, class and section information, and historical assessments.

3. Acceptable use

You must not:

• upload data about anyone you do not have a lawful basis to upload, or upload data outside the categories the platform is designed for;
• use the platform to bully, harass, or single out a student on the basis of their performance or medical observations;
• attempt to access another school's data, another user's account, or system internals you have not been granted access to;
• reverse engineer, scrape, or otherwise extract the platform's code, algorithms (APR, PPS, medical-safety logic), or training data;
• upload malware, spam, or content that infringes anyone's intellectual property or publicity rights; or
• use the platform to send unsolicited communications, advertise, or solicit students or parents for purposes outside their educational and athletic development.

4. Scout interactions

Scout users may search and contact verified athletes only through audit-logged channels and only within the consent boundaries the school has set. Direct outreach that bypasses the school is a violation of these Terms and may result in immediate revocation of scout access.

5. Content you provide

You retain ownership of the data and content you submit to the platform (your profile, your bio, any avatar image you upload). By submitting content you grant Athlosys a limited, non-exclusive, royalty-free licence to host, display, transmit, and process that content for the sole purpose of operating the platform on your or your school's behalf. Aggregated and anonymised statistics derived from assessment data may be used by Athlosys for research and to improve the platform; individual-level data is never sold or shared outside the boundaries described in our Privacy Policy.

6. Our intellectual property

The Peak Athlete name, peaks mark, brand expression, software, scoring methodology (APR, PPS), and supporting documentation are the intellectual property of Athlosys Sports Private Limited. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. Service availability and changes

We aim to keep the platform available, but we do not guarantee uninterrupted service. We may update, modify, or temporarily suspend any part of the platform — including for maintenance, security incidents, or major releases. For changes that materially affect features or pricing, we will give reasonable advance notice to participating schools.

8. Suspension and termination

We may suspend or terminate an account that breaches these Terms or that exposes other users or the platform to risk. Schools may terminate their engagement with Athlosys by following the off-boarding procedure set out in their commercial agreement; on termination, Athlosys will export the school's data on request and delete or anonymise it within the timelines described in the Privacy Policy.

9. Disclaimer of warranties

Peak Athlete is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Athlosys disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

APR, PPS, and medical-safety signals are decision-support tools intended to help PE teachers and school administrators. They are not a substitute for professional medical advice, diagnosis, or treatment, and they do not replace the judgement of a qualified physician.

10. Limitation of liability

To the maximum extent permitted by law, Athlosys' aggregate liability arising out of or related to these Terms or the platform is limited to the fees paid by the school to Athlosys in the twelve (12) months preceding the event giving rise to the claim. Athlosys is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of goodwill.

11. Indemnity

You agree to indemnify and hold Athlosys harmless against any third-party claim arising from your breach of these Terms, your misuse of the platform, or content you uploaded that infringes the rights of another person.

12. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Goa, India.

14. Changes to these Terms

We may revise these Terms from time to time. When we do, we update the "Last updated" date and, for material changes, notify schools and other users in advance. Continued use of the platform after the effective date of a change constitutes acceptance of the revised Terms.
